These Terms of Service (“Terms”) are a legal agreement between you and PressPrep.ai LLC (“Press Prep,” “we,” “us,” or “our”) and govern your access to and use of the Press Prep website and services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Press Prep provides AI-assisted media interview preparation, including reporter briefs, likely questions, talking points, practice interviews, and debriefs. We may add, change, or discontinue features at any time.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.
3. Subscriptions, credits, and billing
- Paid plans and credit-based usage are billed through our payment processor, Stripe. By subscribing, you authorize recurring charges until you cancel.
- Subscriptions renew automatically for the applicable period unless cancelled before the renewal date. You can manage or cancel your plan from your account.
- Fees are stated at the time of purchase and are exclusive of taxes, which you are responsible for where applicable.
- Except where required by law or expressly stated, payments and used credits are non-refundable. Cancelling stops future charges but does not refund the current period.
- We may change pricing prospectively; changes apply to your next billing cycle.
4. Acceptable use
You agree not to:
- Use the Service unlawfully or to infringe the rights of others.
- Upload content you do not have the right to provide, or that is unlawful or harmful.
- Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service or its systems.
- Resell or provide the Service to third parties except as expressly permitted.
- Use the Service to generate deceptive, fraudulent, or misleading content.
5. Your content
You retain ownership of the content you submit, including documents, interview details, forwarded emails, pasted transcripts, published coverage, and practice recordings (“Your Content”). You grant Press Prep a non-exclusive, worldwide license to host, process, and use Your Content solely to operate and provide the Service to you, including sending relevant content to our AI service providers as described in our Privacy Policy. You are responsible for Your Content and for having the rights necessary to submit it.
6. AI-generated content and no professional advice
The Service uses artificial intelligence to generate outputs, including reporter research, predicted questions, talking points, practice interactions, and debrief scoring. These outputs are AI-generated, are provided for preparation and practice purposes only, and may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for reviewing and verifying all reporter research and generated content before relying on or using it. Press Prep does not provide legal, public relations, crisis, financial, or other professional advice, and the Service is not a substitute for a qualified professional. You use AI outputs at your own discretion and risk.
7. Intellectual property
The Service, including its software, design, and content (excluding Your Content), is owned by Press Prep and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.
8. Third-party services
The Service relies on third-party providers (for example, AI, payment, email, and hosting providers) and may link to third-party services. We are not responsible for third-party services, and your use of them may be subject to their own terms.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service or others. Provisions that by their nature should survive termination will survive.
10. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or reliable.
11. Limitation of liability
To the maximum extent permitted by law, Press Prep and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (USD $100).
12. Indemnification
You agree to indemnify and hold harmless Press Prep and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.
13. Governing law and disputes
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New York will have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Service, and you consent to their jurisdiction and venue.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new effective date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
